The day Joe Biden was installed as president, he sat down at the Resolute Desk in the Oval Office and began signing a tower of executive orders, all of which were designed to quickly implement a far-left, anti-America first agenda.
That included several executive orders reversing the strict immigration and border enforcement policies that Donald Trump had implemented, all of which combined to produce the lowest levels of illegal immigration and the smuggling of dangerous drugs we’d seen in years.
The results were predicted and predictable: Illegal immigration and drug smuggling exploded, along with deaths from deadly fentanyl coming from Mexico’s cartels and made with ingredients shipped to them from China.
One bright spot in that disaster endured, however: The regime’s inability to get rid of Title 42, a statute that was being utilized to quickly turn away migrants who crossed illegally under the guise of limiting the spread of COVID-19.
The administration tried on several occasions to end the rule, but successive federal courts prevented that from happening. Now, however, the White House has finally found a federal judge that will accommodate Biden’s open-borders policies.
“BREAKING — U.S. Judge Emmet Sullivan voids the Title 42 order that has allowed U.S. border officials to quickly expel migrants, finding it ‘arbitrary and capricious in violation of the Administrative Procedure Act,'” CBS News’ immigration reporter, Camilo Montoya-Galvez noted on Twitter.

“This is a major ruling with huge implications. It prevents the U.S. from expelling any migrant under Title 42, a public health authority first invoked by the Trump administration. Judge Sullivan refused to suspend the ruling pending an appeal,” Montya-Galvez added.

“This ruling is of enormous significance for asylum-seekers and will hopefully put an end to the misuse of public health laws to block desperate people from seeking protection,” said the ACLU’s Lee Gelernt, who filed the lawsuit.

Critics of the ruling blasted the decision and predicted that illegal immigration and drug smuggling is only going to get worse now.
“This decision — which takes effect immediately — knocks down one of the last remaining barriers to complete anarchy at the border,” said a statement from the Federation for American Immigration Reform. “If the Biden administration does not appeal, it will be one of the most egregious derelictions of duty when it comes to border security, once again proving that the crisis is deliberate and something they never intend to fix.”
In response to the decision, Texas Gov. Greg Abbott (R) decided not to wait on whether someone will appeal the ruling: He declared an “invasion,” thereby empowering law enforcement in his state to take action to return people who have crossed illegally to the border.
According to Andrew R. Arthur of the Center for Immigration Studies:
Texas Gov. Greg Abbott (R) invoked the invasion clause of the U.S. and Texas constitutions this week, providing additional power to state authorities to protect the state’s 1,254 mile border with Mexico against drug and migrant entries. Desperate times call for desperate measures, and things are desperate at the Southwest border in Texas.
Joe Biden inherited what Rodney Scott, his first Border Patrol chief, described last September as “arguably the most effective border security in” U.S. history, but he quickly allowed it to “disintegrate” as “inexperienced political appointees” ignored “common sense border security recommendations from experienced career professionals.”
