A federal jury has ordered former President Donald Trump to pay an additional $83.3 million in damages to former advice columnist E. Jean Carroll, who claims that Trump damaged her reputation after calling her a liar after she accused him of sexual assault.
Senior Judge for the Southern District of New York Lewis A. Kaplan – appointed by Democratic former President Bill Clinton – announced the jury’s verdict on Friday, Jan. 26. The jury decided that Trump must pay Carroll $18.3 million in compensatory damages and $65 million in punitive damages.
Carroll claims without evidence that, in 1996, during a chance encounter with Trump at a Bergdorf Goodman in New York City, Trump supposedly sexually assaulted her. This is the second time a jury has handed down a verdict in Carroll’s favor and related to this supposed event. In May, a different jury ordered Trump to pay Carroll $5 million. The jury found the former president not liable for rape but responsible for two statements he made as president when he answered reporters’ questions after excerpts of Carroll’s memoir were published. These two statements denying Carroll’s allegations were the basis for her claiming that the former president defamed her.
In this second trial that just concluded, Kaplan limited what Trump could say in his defense, claiming that he had “missed his chance” to argue his innocence. This meant that Trump only had a few minutes on the witness stand, during which he denied attacking Carroll and then talked about how “this is not America.”
The jury deciding whether or not Trump was liable for damages was reportedly only asked how much Trump should pay Carroll for the two aforementioned statements he made. Carroll’s attorneys had requested $24 million in compensatory damages and a still unknown but “unusually high punitive award.”
In a statement posted on his account on the social media platform Truth Social, Trump said the court’s decision should not be representative of the legal system in the United States and claimed that President Joe Biden is using his incumbency to conduct a “witch hunt” against him.
“Absolutely ridiculous! I fully disagree with both verdicts and will be appealing this whole Biden-directed witch hunt focused on me and the Republican Party,” Trump posted shortly after the verdict against him was read. “Our legal system is out of control, and being used as a political weapon. They have taken away all First Amendment rights.”
Trump also accused Kaplan of depriving his right to due process by refusing to let the jury see Carroll’s interview with Anderson Cooper on CNN, which could have helped exonerate him as it features Carroll stating that “rape is sexy.”
“Judge Kaplan is refusing me my constitutional right to due process, to defend myself against this false accusation,” wrote Trump. “This is a one-sided trial, where the other side is allowed everything, and we are allowed nothing. He is an extremely abusive individual, the likes of which few have seen before.”
